When must the rent be paid?
The usual arrangement is for the rent to be paid on the first day of each term (month, week, etc.). Nevertheless, the parties can agree on any other date that suits them better.

 

Where must the rent be paid?
If the parties have not made any special arrangements, generally the landlord or his representative collects the rent at the tenant's residence on the agreed-upon date.

If the tenant is away at that time, the landlord does not have to come back repeatedly; it is up to the tenant to send him the rent promptly.

If the landlord and tenant have decided otherwise, the landlord does not have to fetch the rent. The tenant must send the rent enough in advance so that the landlord receives it on time.

In either situation, it is in your best interest to reach a clear agreement on the arrangements, especially on a precise time for payment to be made, such as on the first of the month between 7 and 9 p.m.

Both parties must act in good faith without abusing their rights.

 
Who must be paid?
It is essential to ensure that payment is made to the right person (the landlord, his representative, a management company, etc.). Otherwise, there is a possibility of having to pay a second time.

Certain events could occur that might make the tenant uncertain about whom the rent is owed to. These could include sale of the building, a death, a bankruptcy, or withdrawal of authorization to collect the rent due to a mortgage. In such cases, a tenant can ask the Régie for authorization to deposit the rent with them.
