The seller must garantee that the property
and accessories are free from hidden defects, unless otherwise specified in the promise to
purchase. He also declares that he is not aware of any factor liable to reduce the value
of the immovable.
The seller must also declare and certify:
- that he has not received any notice from a competent authority indicating
that the immovable does not conform to the laws and regulations in force
- that any notice from an insurer, following which he has not fully
remedied the defect
- that the immovable is provided with water and sewer services or other
(disposal field, septic tank, sump, etc...)
- that the immovable is not part of a housing complex
- that it is not subject of the Act to preserve agricultural land and that
it is not classified or recognized as cultural property under the cultural Property Act.
- that the immovable conforms to the laws and regulations relating to
proptection of the environment
- that in the case of an immovable with leases, this must be mentioned
The promise to purchase contains a clause by chich the seller promises
to deliver the immovable in the condition in which it was when the buyer examined it.
